NARRATIVE

The following is a summary of events pertaining to report #24019292:

On Sunday, April 7, 2024 at approximately 5:50pm I, Officer Rymill responded to the parking lot of 530 Mystic Ave. for a

reported MVA. Somerville Police units were already on scene. Upon arrival, SPD units directed my attention to Orlane

Pena whom was believed to be under the influence of an alcoholic beverage.

It was determined that while in operation of her vehicle (2011 blue Audi Q5 MA reg. XXXX) in the parking lot of 530 Mystic Ave., which is owned and maintained by the SHA with public access, she rear ended the vehicle in front of her  (2023 gray Toyota Corolla MA reg. XXXX).

Ms. Pena then exited her vehicle with it in reverse, and it ran over her feet before colliding with a parked vehicle (2018 gray Toyota Rav4 MA reg. XXXX). Paramedics were called to the scene and subsequently cleared as involved parties

declined to go to the hospital for further evaluation.

In speaking with Ms. Pena she appeared to be in a dazed state and I observed her eyes to be glassy. I asked her if she

had any injuries that would prevent her from completing a field sobriety test, to which she responded in the negative. I then instructed Ms. Pena to follow me over to a side of the parking lot where it was dry, level, and free of any debris.

The first test I administered was the Horizontal Gaze Nystagmus Test. I utilized the tip of my pen I keep with me as a stimulus. Ms. Pena stated she was able to see the tip of the pen. I explained to Ms. Pena, I wanted her to follow the tip of the pen with her eyes only and not to move her head.

I asked Ms. Pena if she understood, to which she responded in the affirmative. While performing said test, Ms. Pena had to be reminded to keep her head still. I observed a lack of smooth pursuit in both eyes, Nystagmus prior to 45 degrees, and sustained Nystagmus at maximum deviation.

The second test I administered was the walk and turn. I demonstrated the test, instructing Ms. Pena to walk in a straight line while placing one foot in front of the other, with the heel of her front foot touching the toe of her back foot.

Ms. Pena stated she understood and asked Right now? I instructed her to begin, to which she repeatedly asked Right now? before beginning the test.

Ms. Pena did not adhere to the aforementioned heel to toe method and kept walking, before being warned of a parked car in her path.

The third and final test I administered was the one leg stand. I explained the test and demonstrated the height of approximately six inches by raising my foot off the ground.

While her foot was raised, I instructed Ms. Pena to count out

loud until I told her to stop. Ms. Pena stated she understood the test and began to instead again attempt the walk and turn.

I reminded Ms. Pena of the current test, to which she again attempted a walk and turn. Ms. Pena was reminded of the

instructions, to which she again began to walk forward.

At that time, I believed Ms. Pena to be under the influence of an alcoholic beverage and placed her in handcuffs (DL).

Transport vehicle (200) was requested and arrived on scene. An inventory of Ms. Penas vehicle yielded three open

containers of wine.

All of which were taken to SPD and logged into evidence. Ms. Pena arrived at the SPD where she was afforded all her rights and booked by Lt. Fusco in the usual manner. Ms. Penas vehicle was towed by Stephens Automotive Transport in Medford, Ma.

Orlane Pena is being charged with:

C. 90 S 24 Operating a MV Under the Influence of Alcohol

C. 90 S 24 Possession of an Open Container of Alcohol in MV

Orlane Pena was issued MA Uniform Citation T3007429 for the same.
