On 3/28/2024, I, Officer McCune was assigned to marked unit East-4 working for the Somerville Police Department. At approximately 12:45 AM, I was on routine patrol in the mystic housing projects. At the corner of the Canal Lane and River road, I observed two motor vehicles, running, side by side blocking the street. As I approached the two vehicles they both took a right hand turn from River Rd. onto Memorial Rd. disregarding the stop sign located at the corner of River Rd. and Memorial Rd. I continued to follow the vehicles from a distance where I observed MA. reg. XXXX, registered to a XXXX, fail to stop at another stop sign located at the corner of Memorial Rd. and Temple St. It was at this point where I activated my emergency blue lights and sirens in an attempt to stop the motor vehicle. At this point, the vehicle was not responding to my lights or sirens, so I radioed to dispatch my location and the situation. I continued to follow the vehicle and update dispatch of my location. The motor vehicle continued to go through multiple stop signs and red lights as I was following behind it from a safe distance. Eventually, the motor vehicle picked up speed well beyond the city speed limit and took a right hand turn onto to Franklin st. from Broadway, both which are public ways in the city of Somerville. I would like to note that Franklin st. is a one way street, prohibiting access from Broadway. At this point I disengaged the motor vehicle stop due to the increased risk the motor vehicle was causing to public safety.

     Around 1 AM, Officer D. Ruf (East-3), radioed into dispatch that he had located the involved motor vehicle from earlier at 10 Skehan St. in Somerville. I responded to that location along with Officer J. Martins (East-2), and Officer M. Cleary (E1). Upon my arrival, I observed a male in handcuffs standing outside of the vehicle. I approached the male and asked him if he had realized the severity of what he had just done. I than asked him for his license and registration and he informed me that he did not have a license and that this was not his vehicle. He than gave me his name and DOB, XXXX (XXXX). A CJIS query of the name and date of birth yielded negative RMV results. Mr. MIAHJEE informed me that this was his girlfriends father's vehicle and that his girlfriend gave him the keys to use it. When I asked MIAHJEE why he did not not stop and he said because he did not have a license. I explained to him the severity of his actions and how lucky he was that he had not been hurt or anything other citizens. At this point I read Mr. MIAHJEE his Miranda rights from a card that  keep in my vest pocket. I again asked Mr. MIAHJEE if he had been the person driving the vehicle tonight to which he stated "Yes". Mr. MIAHJEE was than placed under arrest and I radioed for unit 200, the prisoner transport vehicle operated by Officer K. Lentini. Mr. MIAHJEE was searched incident to arrest as well as the vehicle. and than transported back to Somerville Police Station and booked in the usual manner by Sgt. Scrugli.

      Along with Officer J. Martins, I conducted a follow up at 10 Skehan St. in order to inform the owner of the vehicle what had occurred tonight. At the house, we were met by XXXX (XXXX). I asked Ms. XXXX if she owned a vehicle bearing MA reg. XXXX to which she stated that it was her husbands vehicle. Ms. XXXX invited us into her home where we waited while she got her husband, XXXX. When both parties returned to the living room I explained to them what had happened tonight and if they knew that there vehicle was being used by Mr. MIAHJEE. They stated that they did not know that the vehicle was being used and that they would never give him permission to use the vehicle. When asked how he would have obtained the keys to the vehicle, Ms. XXXX stated that her daughter must have given them to him without their permission.Their daughter was identified as XXXX (XXXX). She will be referred to as JV1 from here on out. While speaking with JV1, she stated that Mr. MIAHJEE is currently homeless and that she gave him the keys to car so that he had somewhere to sleep for night. She stated that she did not think he was going to be out driving the vehicle.

     After speaking with both the parents and JV1, Mr. XXXX went to check his vehicle to make sure that nothing was missing. Mr. XXXX stated that everything appeared to be in order. I would like to note that JV1's cellphone and the other set of car keys were with placed in Mr. MIAHJEE'S Property and later returned to Mr. XXXX by Officer J. Martins with the approval of Sgt. Scrugli. During the booking process, I was informed that Mr. MIAHJEE made statements of wanting to harm himself and that he has made attempts to harm himself in the past. Cataldo was immediately notified and I filed for a section 12. After the booking process was over, Mr. MIAHJEE was transported to Cambridge Hospital and accompanied by Officer k. Lentini.

     Mr. MIAHJEE will be charged with the following: 

     UNLICENSED OPERATION OF MV c90 S10

     NEGLIGENT OPERATION OF MOTOR VEHICLE c90 S24

     USE MV WITHOUT AUTHORITY c90 S24

     STOP FOR POLICE, FAIL c90 S25

    

     Massachusetts Uniform citation #T3309211 and #T3309212 were left with Mr. MIAHJEE'S Property.
