On Thursday, March 7, 2024, while assigned to marked unit East-1, I, Detective Ashley Catatao, was dispatched to Stop & Shop, located at 779 McGrath Highway, for the report of an assault. Marked unit East-4 also responded. As we were responding to the call, Somerville Control updated us that the reporting party, later identified as XXXXXX, provided a description of the suspect as a Hispanic male, with shoulder length hair, wearing blue pants, and was in possession of a knife. We were then updated again that they had the suspect stopped by the Tesla charging stations next to Blakely Avenue.

As Ofc. McAloney and I pulled up, we observed the suspect, later identified as Noe Hernandez, being treated for a facial wound by Somerville Fire. Ofc. McAloney and I immediately secured Hernandez and Ofc. McAloney pat frisked him and located a knife in his right, pant pocket. I then radioed to Somerville Control and requested a Spanish speaking officer to help interpret due to Hernandez only speaking Spanish. Cataldo EMS then arrived on scene and evaluated both Hernandez and the victim, XXXXXX. As soon as marked unit East-2, Detective Jason Costa, arrived on scene, Ofc. McAloney spoke with Mr. XXXXXX and his daughter, XXXXXX, while I spoke with Hernandez with Detective Costa interpreting.

According to Hernandez, he was just charging his phone when he and Mr. XXXXXX became involved in an argument and Mr. XXXXXX punched him in his face. Ofc McAloney then informed me that Mr. XXXXXX, his daughter, Ms. XXXXXX, and a man, later identified as XXXXXX, who was at the store shopping when he witnessed the entire event, all stated that Hernandez pulled out a knife and pointed it at Mr. XXXXXX and then punched him in the face, on the left side of his face, twice. I did observe blood on the left side of Mr. XXXXXX 's chin and a small gash on the right side of his chin. Mr. XXXXXX punched Hernandez back, in self-defense, striking him in the face, causing Hernandez to bleed from his nose. Mr. XXXXXX and his family tried to walk away from Hernandez but Hernandez continued to follow them. Ms. XXXXXX had already called E-911 at least once by this point and called again. Once Ofc. McAloney informed me of these events, I placed Hernandez under arrest. Hernandez was handcuffed and the cuffs were double locked and checked for tightness. I then radioed to Somerville Control to send marked unit 200 to transport Hernandez back to the Somerville Police Department. Once he was transported back to the station, he was booked by the shift commander. Mr. XXXXXX was advised.

Hernandez will be charged with the following charges:

                - 265/15B/A - Assault with a Dangerous Weapon (to with knife)

                - 265/13A/B - Assault & Battery (two counts)

The knife will be entered into evidence.
