The following report is a brief summary of incident #24010460:

On February 24, 2024, I, Officer Dylan Lambert, was working my assigned shift in marked unit East-1. At approximately 2:06 PM, I was dispatched to the area of TJ Max located at 105 Middlesex Avenue, Somerville, MA in regards to a suspicious person, who may be attempting to break into vehicles. The suspect was pulling on several door handles and was described as a white male with a black hat and blue backpack. Sergeant Messaoudi, in marked unit S8 and Officer Pavao, in marked unit East-3 responded to assist.

Officer Pavao and Sergeant Messaoudi arrived on scene shortly before me. Officer Pavao interviewed the witness, XXXX. Sergeant Messaoudi attempted to locate the suspect and requested a description of suspect over the radio. Officer Pavao provided the description and Sergeant Messaoudi stopped the suspect, Mr. Sean Driscoll in front of TJ Max. Sergeant Messaoudi told me that prior to my arrival, he attempted to make contact with Mr. Driscoll, who was walking at a fast pace toward TJ Max. Sergeant Messaoudi gave Mr. Driscoll commands to stop and place his hands on the cruiser. Mr. Driscoll was slow to respond to Sergeant Messaoudi and started to look around. Sergeant Messaoudi noticed loose change and sunglasses sticking out of Mr. Driscoll's pocket. Loose change is typically taken during a motor vehicle B&E. Sergeant Messaoudi pat frisked Mr. Driscoll for weapons and contraband. While doing so, Sergeant Messaoudi asked Mr. Driscoll if he had any weapons in his possession and Mr. Driscoll said he had a knife in his backpack. 

Mr. Driscoll was detained in handcuffs by Sergeant Messaoudi. While being detained, Mr. Driscoll claimed that he was trying to play a prank on his friend, by entering the friend's vehicle. Mr. Driscoll said the friend drives a Honda Civic. I would like to note that Mr. XXXX told us that he witnessed Mr. Driscoll pull on multiple vehicle doors and eventually enter a Subaru Outback bearing MA registration XXXX. According to CJIS Web the owner of the vehicle was a Ms. XXXX, who we were unable to locate.  Mr. XXXX said that Mr. Driscoll entered the vehicle and appeared to look for items in the car and exited when he noticed Somerville Police officers arriving on scene. Mr. Driscoll claimed that he was with a friend that resided at XXX Perkins Street, Somerville, MA, who went by the name "XXXX."

Prior to being transported to the Somerville Police Department, Sergeant Messaoudi searched Mr. Driscoll's backpack. The following items were in the backpack:

Two sided knife with two blades

Eleven debit cards belonging to a Ms. XXXX, along with a MassHealth card

Tory Burch wallet containing a MA Driver's License belonging to Ms. XXXX. There was a AAA card, MassHealth card, and debit card belonging to Ms. XXXX.

Black Guess Wallet with a MA Driver's License belonging to Ms XXXX. There was also a debit card and BJ's member card belonging to her.

Brown wallet containing a MA Driver's License for a Mr. XXXX. There were also four debit cards, a BJ's member card, and a MA EBT, and a SSI card belonging to Mr. XXXX

A Louis Vuitton Bag was also located on Mr. Driscoll.

There was also a Columbia Jacket located in the backpack, which Mr. Driscoll claimed was his. The jacket still had a price tag on it and when Sergeant Messaoudi asked Mr. Driscoll what size it was he stated it was a small. The size of the jacket was a large. The jacket was returned to Columbia by Officer Pavao, who was provided a receipt, which stated the jacket was worth $129. The receipt will be digitally attached to this report.

At some point after the arrest, Sergeant Messaoudi contacted Ms. XXXX in regards to her recovered items. Ms. XXXX reported that her vehicle was broken into on February 12, 2024 at Home Depot located at 75 Mystic Avenue, Somerville, MA. Please refer to incident #24007682. A search via Somerville Police Department's MNI Database that a death investigation of Ms. XXXX passing occurred on February 16, 2024. Please refer to incident #24008813.   

At around 5:10 PM, Ms. XXXX contacted the Somerville Police Department. I spoke to Ms. XXXX and informed her of the incident that occurred. Ms. XXXX said that she didn't notice any items missing from her vehicle.

At 5:40 PM, Mrs. XXXX, Ms. XXXX Mother, contacted the Somerville Police Department because she noticed that her vehicle, MA Registration XXXX appeared to be rummaged through. Mrs. XXXX said that her Louis Vuitton bag was stolen. The bag was the same one recovered from Mr. Driscoll. Mrs. XXXX said vehicle was parked close to her daughter's vehicle. mrs. XXXX said it was approximately worth $300.    

All of the items will be logged in as evidence at the Somerville Police Department.

Mr. Driscoll was transported to the Somerville Police Department in the transported wagon by Officer Anaya and booked by Lt. Salvatore Fusco. Mr. Driscoll was charged with the following:

266/16 B&E of A Motor Vehicle

266/60 Receiving Stolen Property Over $1200

269/10 Possession of a Dangerous Weapon (Per Se)
