On November 2, 2024 at approximately 12:30 AM, I, Officer Daniel Dell'Isola, assigned to cruiser W7, responded to the area of 37 Sunset Rd. for a report of a male walking on the street with a machete.  Lt. Shackelford, Officer O'Brien, Officer Thompson and Officer Lavey III responded as backup.

When I arrived on scene, I noticed numerous University of Tufts students walking in the street.  Officer Lavey III, who arrived on scene first, along with numerous University of Tufts Police Officers, were talking to a male who was later identified as Jorge Alberto Perez on the side walk in front of 45 Sunset Rd.  PEREZ had his hands raised and on the ground by him was a large machete.  Jorge Alberto Perez only spoke Spanish so we requested for a Spanish speaking officer to arrive on scene to translate. 

While waiting, I asked Officer Lavey III if he knew who the reporting party was and he pointed to a group of four Tufts University students, that were standing across the street from us a few houses down.  I went to speak to the group of four students who were later identified as XXXX, XXXX, XXXX, and XXXX.  I ask what had happened and XXXX informed me that they were heading to friends house on Sunset Rd.  While walking down the street they noticed PEREZ standing in the middle of the street holding a large knife.  I asked XXXX that if he saw someone holding a machete in the street, why would he walk towards him.  XXXX and the group all responded that because Halloween was only a day ago and everyone else around was dressed in costumes, they thought the knife in PEREZ's hand was a costume prop.  XXXX stated that as they got closer, PEREZ turned to them and started yelling at them.  XXXX stated that PEREZ looked at him and said "are you the guys".  XXXX stated that he didn't respond to PEREZ because he didn't know what PEREZ was talking about.  XXXX stated that PEREZ then swung the machete down striking the ground.  XXXX stated that he hit the ground so hard with the machete that it caused sparks to appear.  At this point they called 911.  

I asked XXXX how close was he to PEREZ when PEREZ swung the machete on the ground.  XXXX stated approximately 4-5 feet away.  I then asked XXXX, XXXX, XXXX and XXXX if they were in fear for their lives when PEREZ approached them to which they all stated "yes."

PEREZ was placed in handcuffs by Officer Thompson.  Medford Police Officer Carbone arrived on scene for translation. Officer Carbone read PEREZ his Miranda rights from a card that he had on his person.  Officer Carbone asked PEREZ what had happen to which PEREZ stated that he was inside his apartment drinking alcohol when he heard a lot of noise coming from the street.   PEREZ stated that he believed people were fighting outside his apartment.  PEREZ stated that he grabbed his machete and walked out of his apartment onto the street.  PEREZ was informed that he was under arrest.  Unit 200, operated by Officer Rivera arrived on scene and transported PEREZ back to the station where he was booked by Lt. DeOliveira. 

Perez will be charged with Assault with a Dangerous Weapon, Massachusetts General Law Ch. 265 s. 15B/A and Violation of City Ordinance Possession of Dangerous Weapon Ch. 9 s. 96.

The machete was confiscated.  It will be submitted into evidence and placed in the evidence locker.
