The following is a summary of the details related to this incident.
On Friday, August 9, 2024, I, Officer David Ruf, was in full-uniform and assigned to marked cruiser East-1, for the Somerville Police Department. At approximately 8:52 A.M.,Officer C. Fusco (East-4) and I were dispatched to 148 Broadway for a dispute.
Upon arrival I observed a male, later identified as XXXX, and a female known to me, Nicole Goroshko, in the middle of the street. The male party was attempting to retrieve a cell phone when the female party threw it in the middle of the road.
I spoke with XXXX first who stated the following; he let Nicole use his cell phone so she could listen to music. She then stated that it was her phone and refused to give it back. She then smashed the phone against a pillar cracking the screen before she started walking in the middle of the road when officers arrived. It should be noted that XXXX possessed the code to unlock the phone and that the language on the phone was all in Spanish.
I then asked Nicole what had taken place and she stated the following; she asked XXXX to use his phone to listen to music. She then recognized the phone to be hers because of the color and one small crack on the top of the screen. It should be noted that it was a standard I Phone that was not a specialty color.
I also spoke with a witness, XXXX, who stated the following; he was standing outside of the community center charging his phone. He saw that XXXX let Nicole use his phone to listen to music. When XXXX wanted his phone back, Nicole refused and started smashing it of a brick pillar.
Based on the statements made by XXXX and XXXX, I placed Nicole under arrest for the following;
M.G.L. c266 / ยง126a DEFACEMENT MALICIOUS WANTON PROPERTY
She was transported by Unit #200, Officer T. Sullivan, to the Somerville Police Headquarters where he was booked by Lt. Holland in the usual manner.
