On Saturday, July 13th, 2024, I was working my assigned 8AM to 4PM shift in the East-4 cruiser. At around 2:31PM, Officer Keighla McAloney (East-1) and I, were dispatched to 18 Dartmouth St. for a report of someone throwing bottles at the reporting party. Officer Cassandra Campers (East-2 also responded). The following is a summary of the incident:

Upon arrival, we were met by the reporting party, Mr. XXXX. Mr. XXXX stated that he was outside, prepping his motorcycle when Mr. Nelson Martinez Aguilar yelled "Mother Fucker!" at him from the porch. Mr. Martinez Aguilar then threw a glass, Corona bottle down from the porch at him. The bottle missed and shattered on the sidewalk, feet from where he was standing. next to his motorcycle. Moments later, Mr. Martinez Aguilar then yelled "Mother Fucker" at him several more times and threw a second Corona bottle at him. The second bottle shattered on the sidewalk, in front of 14 Dartmouth St. Mr. XXXX then yelled out to Mr. Martinez Aguilar that he had called the police. Mr. Martinez Aguilar then walked down the porch steps and approached Mr. XXXX at his motorcycle and again started yelling "Mother Fucker!" in his face and told him that he didn't care if he called the police. Mr. XXXX stated that Mr. Martinez Aguilar got closer and closer to him so Mr. XXXX spit at him, told him that he called the police and that they were coming. Mr. Martinez Aguilar then went back to sit on the porch.

When I walked up the porch steps, I could see Mr. Martinez Aguilar sitting in a chair on the porch, with a box of empty Corona bottles next to him. Mr. Martinez Aguilar stated that he was sitting on the porch when Mr. XXXX came up to him and spit in his face then went back down to his motorcycle and kept revving it. I asked him if he threw at bottle at him and he said yes and repeated "Stupid mother fucker" several times, referencing Mr. XXXX. He stated that he threw the bottle because he spit in his face.

Mr. XXXX was sitting in the far corner of the porch, by himself. When I asked him what happened, he stated that he saw Mr. Martinez Aguilar throw bottles off of the porch. He also stated that he did not see Mr. XXXX come on to the porch at any time.

Officers noticed many broken Corona bottle shards on the sidewalk surrounding where Mr. XXXX motorcycle was and in front of 14 Dartmouth St. Pictures have been attached to this report.

I placed Mr. Martinez Aguilar under arrest for two counts of Massachusetts General Law C. 265 S.15B/A: Assault with a Dangerous Weapon. He was transported to the station by the Prisoner Transport Wagon, Unit 200, operated by Officer Robert Taylor. He was booked by Lieutenant Salvatore Fusco.
