On Friday, June 21st, 2024 at 10:20pm, Somerville Police Control received a call regarding a motor vehicle accident in the area of 78 Perkins St.
I, Officer Barton (E1) was dispatched to that location.
While en route, I was informed that the operator was attempting to leave the scene, which then prompted Somerville Police Control to send Officer Fusco (E4).
Upon my arrival, I observed a sedan (MA REG #XXXX) wedged nearly perpendicular in between two other parked motor vehicles on opposite sides of Perkins Street (MA REG # XXXX & MA REG # XXXX) causing the latter to rear-end MA REG # XXXX. It also appeared that the crashed vehicle also side swiped MA REG # XXXX prior to getting stuck.
I would like to note that Perkins Street is a public way as defined by the Commonwealth of Massachusetts as well as a one-way street from Mt. Pleasant St. to Mt. Vernon St., where the crash occurred (78 Perkins) with street parking on both sides.
As I approached the vehicle, I observed a black male, rummaging through the front portion of the car. I asked if he was ok and if there was anything that I could help him with and he stated that he was looking for his phone.
I asked the individual if he required any medical attention and he declined, but due to the severity of the collision, EMS was requested anyway. It should be noted that the airbags were not deployed.
I then asked the male to step out of the vehicle and for his license, to which he stated that it was in the back of his phone, in his phone case.
The male continued looking for his phone and picked up and dropped a black backpack that was located on the passenger's seat, and when the bag landed, I heard the sound of two glass bottles colliding.
I then ordered the individual to step out of the motor vehicle and to provide me with his name and D.O.B, to which he provided his license number (XXXX) which I then queried in CJIS and it came back to a Jeffrey STFLEUR.
As STFLEUR recited his license number to me, I could smell the odor of an alcoholic beverage emanating from his breath.
I asked STFLEUR what had happened to cause the crash, and he stated that as he was driving, his "wheel came off". At this time, I again smelled the odor of an alcoholic beverage and observed that STFLEUR's eyes were bloodshot and that he was swaying back and forth, unsteady on his feet.
At one point while I was assisting STFLEUR in locating his phone, SFD Lt. XXXX noticed that the key was still in the ignition, so he reached in and turned the car off and placed the key on the dashboard.
I then went around the car to the passenger's side to further investigate the backpack that had glass bottles inside, as well as continue looking for STFLEUR's phone which he adamantly was requesting be found, which is when I observed the front passenger side tire bent off of the axle.
At this moment, I knew that the motor vehicle was not able to drive and needed to be towed, to which Stephen's Tow was notified and ended up ultimately towing the vehicle. I then opened the front passenger's door and observed a glass bottleneck with a blue, translucent wrapping in plain view in the opening of the black backpack in the front seat, to which I recognized it to be a bottle of alcohol, based on my training and experience. I then opened the bag further and retrieved one empty glass bottle of Chivas Regal scotch and one empty glass bottle of Casamigos Tequila (Photo Attached).
I would like to note that when I did locate STFLEUR's phone, it was located between the floorboard and the seat on the front passenger's side and it was unlocked with the Snapchat app active.
STFLEUR was being evaluated by Cataldo EMS as that was happening, which he adamantly refused any treatment and to be transported to the hospital, against the professional advice of the EMTs.
Fusco also asked STFLEUR if anyone else was in the vehicle, to which he replied "Just me, myself, and I". The black backpack located on the front passenger's seat led Officers to believe that to be the truth.
As STFLEUR was signing the refusal, he used his GVR CRAVE MAX vape, which was then confiscated to prevent its effect from potentially altering STFLEUR's performance in the Standard Field Sobriety Tests (SFSTs) that Officer Fusco was beginning to attempt bringing him through. STFLEUR was uncooperative and refused the SFSTs by covering his face with his hair (dreadlocks), closing his eyes, looking down, and refusing to respond to any of Officer Fusco's questions. STFLEUR was unsteady on his feet during this evaluation as well.
It was at this moment that STFLEUR was informed that he was under arrest for OUI Liquor and placed in handcuffs.
Unit 200, operated by Mark Canty was then requested to transport STFLEUR back to Headquarters (220 Washington St.) for booking by Lt. Shackelford.
I then read STFLEUR his Miranda Rights from a card that I carry on my person, and when asked if he understood, he remained silent. A few moments later, STFLEUR began making comments about how I was a "Bitch ass nigga" and for me to "suck his dick" I then re-read STFLEUR his Miranda Rights from the same card and again, there was no response to if he understood them.
While waiting for 200 to arrive, Officer Fusco then went back to the large crowd that had gathered due to the crash, to retrieve witness statements as I stayed with STFLEUR.

When STFLEUR arrived at the station for booking, he requested to make a phone call, which Lt. Shackelford permitted, and then when the phone call ended, STFLEUR refused to be booked, including fingerprinting and answering a standard line of questioning.
The two empty bottles of liquor, as well as the white vape were tagged and placed into evidence. It should be noted that there was also an empty Mango High Noon 4-pack box in the vehicle as well as one unopened can of Mango High Noon on the front passenger's floorboard that had been punctured and was spraying fluid (Photo Attached).
I would like to note that there is a RING camera at the residence of 79 Perkins Street, but when I attempted to locate the owner to view the footage, there was no answer at the door.
Massachusetts Uniform Citation #T3310032 was issued against Mr. Jeffrey STFLEUR for 90/24J (OUI Liquor) and 90/24E (Negligent Operation of Motor Vehicle).
Massachusetts Uniform Citation #T3310033 was issued against Mr. Jeffrey STFLEUR for 90/24I (Open Container).
Both Citations were placed in his property.
At the time of the conclusion of this report, STFLEUR has continued to refuse booking, including everything related to the breathalyzer and penalties assumed with refusing to submit.
Based on the observations I made on scene, as well as the witness statements given to Officer Fusco, I will be charging Mr. Jeffrey STFLEUR with:

c.90 S24E - Negligent Operation of a Motor Vehicle
