On Tuesday, June 18th, 2024 at approximately 6:51 p.m., Officer McAloney (East 1) and Officer Ubeda (East 3) were dispatched to Target (180 Somerville Ave) for a shoplifter detained in the loss prevention office. While on scene with this shoplifter, the loss prevention personnel informed officers that they had a second shoplifter. Officer McAloney relayed this information to Somerville Police Dispatch. Upon hearing this radio transmission, I, Officer Campers (East 2) and Officer Ribeiro (East 4) also responded to the scene.
Upon my arrival, officers had a Hispanic male, later identified as Mr. Jose Estrella, detained in the loss prevention office. On the desk was Mr. Estrella's personal belongings including two sets of keys, a wallet, a cell phone, a pocket knife, and a firearm.
Mr. XXXX informed me that he recognized Mr. Estrella from previous shoplifting incidents dating back to December 2023 and totaling approximately $346. Today, as he was monitoring the camera system, he observed Mr. Estrella remove a small item from his pocket (a piece of cardboard with a barcode). Mr. Estrella then proceeded to the self checkout and used this barcode to scan one of the items he was attempting to purchase. The item rang up as Bananas and cost $.79. It is to be noted that Mr. Estrella did not have bananas in his possession and was attempting to purchase health and beauty products.
Mr. XXXX then stopped Mr. Estrella in the vestibule of Target and escorted him to the loss prevention office along with officers. Once inside the office, Mr. Estrella continuously reached into his left side shoe/sock. Officer McAloney ordered him to stop reaching, but he continued to do so. Officer McAloney then requested that Mr. Estrella remove his left shoe. When he did this, the small piece of cardboard with the barcode fell out on to the floor. Immediately after removing his left shoe, Mr. Estrella began reaching into his pockets. Officer Ribeiro noticed a pocket knife clip located on the outside of Mr. Estrellas right hand pant pocket. Officer Ribeiro ordered Mr. Estrella to stand up and not to reach for anything but Mr. Estrella began reaching into his right hand pant pocket. Officer Ribeiro then ordered Mr. Estrella to place his hands on his head, she then remove the pocket knife. As she was doing this, Mr. Estrella informed her that he had a pistol in his possession. Officer Ribeiro then observed the firearm in a holster located in his front waistband, removed it, and handed it to Officer McAloney to render it safe. Officer Ribeiro then asked him Mr. Estrella if he had a License to Carry, to which he replied yes and attempted to reach in his pocket once more. Officer Ribeiro told Mr. Estrella to stop and then searched his right side pocket and was able to retrieve his License to Carry.
Based off the above information, I placed Mr. Estrella under arrest for the following violations:
M.G.L c266 s30a- Shoplifting by Price Tag Tampering
MG.L c266 s30C- Larceny under $1200
SCO 9 96- VCO Possession of a Dangerous Weapon (Pocketknife)
Mr. Estrella's firearm (Glock 43X, SN: BVWF634) as well as the magazine (11 rounds of ammunition), Blackhawk holster and LTC were taken from his possession and will be placed into evidence locker #5 for safekeeping (Tag #24036218 1-5). Officer Ribeiro left a voicemail with the Boston Licensing Authority to inform them that we had confiscated Mr. Estrella's firearm.
The pocketknife was also confiscated and will be placed into evidence with the other items in Locker #5 (Tag #24036218-6). A copy of the receipt, cardboard barcode and target's loss prevention file on Mr. Estrella will be attached to this report.
