On the evening of Monday, June 14, 2024, while in uniform, I was assigned to marked unit East-2. At approximately 11:23 PM, I, Officer Lorenti responded to X Fennell Street, for a report of shots fired. Somerville Police Dispatch stated that the reporting party stated that someone had shot 2 rounds in his window. All Somerville Police units responded as well as detective units.
On scene, I was met by Officer Thompson. While I started to speak with him about what was going on, we heard Detective Collazo say, there are two people in a motor vehicle located behind Trum Field on Franey Road. Detective Collazo, Officer Thompson, Officer Desrochers, and I made our way to speak with the parties in the motor vehicle.
Detective Collazo and Officer Desrochers asked them if they had heard anything. Both parties stated that they had observed a young male wearing a dark hooded sweat shirt with jeans and a ski mask walk by them. Moments later they heard loud bangs. The driver stated to Detective Collazo once he heard the loud bangs, he drove around to the front of Trum field where he observed the same male party walking fast on Broadway and Cedar Street, which is the next block over from where the shots had occurred. Once Officer Thompson and I heard the description of the male party, I stated to him that we should canvas the area, to which he agreed. While walking back to our cruisers, we were informed by Officer Haley that the victim, who was identified as Mr. XXXX was having issues with a few parties that reside in the North Street Projects because of his sister, Ms. XXXX. One party being a Mr. XXXX. Officer Haley was sent text messages from XXXX. (See Officer Haley's supplemental report).
Officer Thompson and I started traveling west bound on Broadway which is the direction the witnesses stated the suspect was traveling. Officer Thompson and I drove to Powderhouse Rotary where he drove west bound on Powderhouse Blvd, while I continued west bound on Broadway.
Officer Thompson stated to me that he was going to double back on Powderhouse Blvd the same way he drove to North Street. I stated to him that I was going to drive back the same way on Broadway, however I was going to search Holland Street and Officer Thompson would search Collage Ave. As I was driving east bound on Holland Street, I observed a male matching the description, walking west bound in front of 167 Holland Street. I informed Officer Thompson that I had just driven by a party matching the description given earlier by the two parties earlier. I told Officer Thompson he was wearing a black tee shirt, jeans, and that he had either a black shirt or a black bag over his shoulder.
Officer Thompson met me on Holland Street where I had turned around to drive back west bound. Once in front of 167 Holland Street, we did not see the male party any longer. Officer Thompson believed the male party had cut through the Lou Ann David Park to which we searched that area to no avail. Officer Thompson and I headed back to the intersection of Broadway and Holland Street where I observed the male on the opposite side of the street from where I first had observed him. He was in front of Rudy's Cafe, (248 Holland Street).
It was at this point I decided to stop the male party. I drove to the male parties location which was now at the intersection of Broadway and Clarendon Ave. I made contact with the male party as I pulled up to him. I ordered him to stop to which he replied "Nah nah nah". I again ordered him to stop, to which he started walking in a fast pace away from me as I exited my marked police cruiser.
At this point, Officer Thompson continued to drive ahead of our location. Officer Thompson positioned himself in front of the male party. The male party saw Officer Thompson and turned back at me. I then ordered him to put his hands up. At first he did not comply. I then repeated my commands to put his hands up, to which he complied. As Officer Thompson and I approached the male party with his hands up, he stated out loud, "I'm going to jail, can I just hit my vape one more time"? I conducted a pat frisk of the male party, where I immediately felt what I believed to be a firearm, located in his front right pocket.
I then conveyed to Officer Thompson that the male had a firearm in his pocket. It was at this point that Officer Thompson placed the male party into custody. I removed a black firearm from LEPAGE'S pocket. I subsequently walked the firearm to my cruiser where I made it safe by ejecting the magazine which contained 1 round of 9mm ammunition and I ejected 1 round from the chamber.
I went back to the male party and asked what his name was? He stated that his name was Sebastian LEPAGE. Officer Thompson read LEPAGE his rights pursuant Miranda. I then asked him where he was coming from. He stated Davis Square. I then asked him what the issue he had with XXXX was. LEPAGE smiled, looked down to the ground and stated there was no issue with him. Officer Thompson asked LEPAGE if he had an issue with XXXX sister, to which he replied he didn't know anything about his sister. While asking those two questions, LEPAGE asked if he could text someone? I told him not at this time, however LEPAGE'S phone which was located on the stairs directly to his left was continuously lighting up. Officer Thompson observed the name " XXXX " on the screen. Officer Thompson asked LEPAGE if it was XXXX who is known to him. LEPAGE just laughed. LEPAGE went on to say that XXXX hasn't been around for about a week.
Officer Fusco arrived on scene. He queried the firearm, (Glock 43X), from his laptop located in his cruiser. The results of the query showed that the firearm in question was reported stolen out of Reading Ma on May 14, 2024. (See Officer Fusco supplemental report.)
Unit 200 was requested to transport LEPAGE to Somerville Police Station to be booked in the usual manner by Lt. DeOliveira. LEPAGE is charged with the following:
