On Wednesday June 5th, 2024 at 2:28pm, Somerville Police Control received a call from Nike Factory Outlet, located at 300 Artisan Way regarding two Hispanic male shoplifters with brown Macy's bags.
I, Officer Barton (E1) along with Officer Fusco (E4) responded to that location.
Upon my arrival, I retrieved photos of the suspects from Nike's Loss Prevention Officer, XXXX and distributed them to Officer Fusco (Attached).
I then made my way to the Assembly Row Security Office to review the footage for the suspects' direction of flight with the Director of Assembly Row Security, XXXX.
While in the process of gathering that information, Officer Fusco radioed to me that he had located the suspects and was with them on a bench outside of LegoLand on Assembly Row.
I then made my way to Officer Fusco's location and confirmed it was the same individuals from Nike's surveillance and observed what appeared to be several pairs of brand new
sneakers from various stores inside their large Macy's bags.
It should be noted that a female identified as XXXX was with those two parties upon my arrival, but not present during the Nike shoplifting or caught on camera.
It soon became apparent that the two individuals did not speak English and were Spanish speaking only. XXXX, who at that point was on scene with Officers, then stated that he was fluent in Spanish and offered to translate.
Through XXXX, the suspects were asked if they had any receipts for the sneakers, most of which still had price stickers and price tags on them. The suspects were unable to provide Officers with any receipts but continued to reach inside their pockets and bags, despite being told to stop via XXXX. The suspects did not listen to commands and continued to stand up from a seated position change their stance and the direction they faced, often looking past us to what was behind us, all while reaching into their pockets and bags.
At this point, for Officer Safety, the parties were placed in handcuffs and frisked, yielding no weapons.
Several pairs of sneakers were located in their bags from Adidas, Puma, and Nike, which prompted Officer Fusco to retrieve a representative to collect the merchandise.
Suspect one then gave the information of " XXXX - D.O.B. XXXX " which yielded no results via CJIS.
Suspect two had a social security card with the number XXXX, which also does not yield any results in CJIS.
At this point the individuals were informed that they were under arrest and Officer Fusco then requested for Unit 200 to respond to transport the parties back to Somerville Police Headquarters.
Suspect one had in his possession $90 worth of stolen merchandise from Nike (1 item), $135 worth of stolen merchandise from Adidas (2 items) and $75 worth of stolen merchandise from Puma (1 item).
Suspect two had in his possession $95 worth of stolen merchandise from Nike (1 item) and $147 worth of stolen merchandise from Adidas (3 items).
All merchandise was returned to their respective stores. Photo of receipts are attached.
It was not until booking at Somerville Police Headquarters with Lt. Holland and translation via Officer Henriquez that suspect one was positively identified as Jose CARVAJAL (XXXX) and suspect two identified as Deimer ALVAREZ BETANCUR (XXXX).
Jose CARVAJAL will be charged with:
c.266 S30A - Shoplifting by Concealing Merchandise
c.266 S60B - Receiving Stolen Property -$1200 (2 counts)
Deimer ALVAREZ BETANCUR will be charged with :
c.266 S30A - Shoplifting by Concealing Merchandise
c.266 S60B - Receiving Stolen Property -$1200
