On 5/27/24 at approximately 2:00PM, I was dispatched to XX Gilman St. for a report of shots fired.

Patrol Units responded to this area and spoke to the witness in this matter, XXXX, who stated he witnessed an altercation outside his building on Jasper St. during which one individual, later identified as Juan Ramos-Gomez,  discharged a firearm toward the direction of another male. The round appeared to ricocheted off the pavement and enter through a bedroom window of XXXX apartment. XXXX stated he videoed the entire incident with his smart phone. XXXX stated he recognized the victim in this matter as one of his neighbors from apartment #2, but did not know his name. XXXX provided the video to me. XXXX stated the gun appeared to be a black semi-automatic hand gun.

A crime scene was established, a damaged shell casing was recovered on Jasper St. appeared to be a 380 caliber casing. The casing was photographed and collected as evidence. I observed and photographed the bullet hole in the window and then went into the residence to look for the slug which was located on the floor of the bedroom. It was photographed and collected as evidence.

I reviewed the video provided by XXXX. It was taken at 11:46AM from behind the air conditioner mounted in the window. In reviewing the video, I observed a heavy set male, later identified as Juan Ramos-Gomez,wearing a navy blue hat, navy blue three button collared shirt, black high top sneakers, and blue jeans holding a black semi-automatic handgun in his right hand. He was arguing with two Hispanic males, both wearing black. One male, tall and thin, with curly black hair, wearing black pants, a black jacket, and the other was short and thin with a black hat, black t-shirt, and black jeans on. The taller one was subsequently identified as XXXX. XXXX and Ramos-Gomez went back and forth arguing during which Ramos-Gomez fired a round toward the feet of XXXX, striking the cement. He then racked another round which ejected onto the street. He picked it up and then entered a white sedan and drove in the direction of Pearl St.  

I along with Det. J. Moreira, and Patrol Unit E-1 K. Henriquez went to apartment #2 looking to speak with the victim. He was not present but I spoke to his roommate, XXXX, who stated her roommates name was XXXX. She provided his wife's phone number. I noted that the mailbox for the apartment listed the names XXXX and XXXX. I then called the number for XXXX and spoke to her. She stated that her husband XXXX was in some type of dispute today with a man known to her as " XXXX ". She stated that XXXX took off from the apartment right after, and she was worried about him.  She stated " XXXX " lived at 59 Pearl St. in the basement. XXXX also provided the phone number for XXXX. I called him multiple times but the phone was off. Earlier in the day, incident 24030782, at approximately 12:00PM, patrol units were dispatched to the area of 59 Pearl St. after an anonymous caller stated there was an altercation there during which she heard gun shots. Units searched the area with no results. It was subsequently learned that the caller in that incident's phone number was registered to 97 Gilman St.  

Based on this information units then went to 59 Pearl St. in an attempt to speak with " XXXX ". Upon arrival we observed a white 2014 Honda Civic registered to Juan Ramos Gomez in the driveway. It had heavy damage to the front windshield, rear windshield, and both the passenger and rear right passenger windows. I observed the vehicle to have a sun roof and the same tire rims as the vehicle involved in the shooting incident. We knocked on the basement apartment door several times. I then knocked on a open window to the apartment at which time a heavy set male wearing the same navy blue hat, navy blue three button collared shirt, black high top sneakers from the video came to the window. I introduced myself and asked him to come to the door. Immediately upon the male party opening the door, he was recognized as the same male from the video provided.

It was at this point that Officer Henriquez acted as an interpreter because the male only spoke in Spanish. The party was informed why we were there and was also read his MIRANDA RIGHTS IN SPANISH, to which he stated he fully understood. The male confirmed his identity and that he was involved in the altercation on Jasper St., and fired the gun. He stated the gun was in a drawer in the kitchen of his apartment. A search of the CJIS system showed no valid LTC listed for Ramos-Gomez. We then secured the apartment pending a search warant to recover the firearm, and I placed Ramos Gomez under arrest for the following MGL violations:

269/12E Discharge of a firearm within 500 ft of a building

265/15B Assault with a dangerous weapon to wit a firearm

269/10G Carrying a Firearm without a license

269/10N Carrying a Loaded Firearm with out a license

Unit 200 transported him to Somerville Police Headquarters, where he was booked according to department policies.

At the station I submitted, the recovered projectile and shell casing into evidence along with Ramos Gomez's clothing which were seized to be tested for Gun Shot Residue.
